Tokayev ordered the establishment of an investment court in Alatau based on the English common law model

A separate judicial system will be established in the city of Alatau to protect the interests of investors and entrepreneurs. Kazakhstan’s President Kassym-Jomart Tokayev announced this during his address to the people of Kazakhstan. Commercial cases will be heard by a special investment court operating under the English common law model.

Other matters related to the city’s special legal regime will fall under the jurisdiction of the civil court. According to Tokayev, Alatau should become a favorable environment for investment and entrepreneurship, and to achieve this, an effective justice system must be ensured. The President added that the investment interests of all bona fide entrepreneurs must be protected by the Constitution.

The government must submit amendments to the Constitutional Law “On the Special Legal Regime of the City of Alatau” to the Kurultai for consideration by the end of January 2027. It is these changes that will enshrine the new judicial system in law.

The English common law model means that courts rely not only on the text of laws but also on judicial precedents—that is, decisions in previous cases. In international commercial practice, it is used because of the predictability of dispute resolution and its well-developed mechanisms for protecting investors’ rights.
